Abstract

This paper
compares the legal system in the United States with that in England. The paper
essentially explores the criminal procedures followed in both countries and the
sources of law. Under the criminal procedures section, the aspects of search
and seizure, arrest, interrogation, self-incrimination, and right to counsel
are discussed in detail. The analysis reveals that both England and the U.S.
follow the common law, and that criminal procedures in both countries are
largely similar. For instance, suspects are legally entitled to be represented
by an attorney in court; they are also free not to answer questions posed to
them by police officers during the interrogation phase. In both countries, it
is an obligation of police officers to obtain warrants before they can arrest
or search suspects. Nonetheless, there are certain exceptions where these
procedures may be conducted even in the absence of a warrant.
